The respondent and the appellant were married November 27, 1954, and divorced June 15, 1959, in Milwaukee. The custody of
their child, Robert, now 4 years old, was awarded to the respondent wife. The divorce decree provided the child should not
be removed from the state without the consent of the court. In June, 1960, the respondent made an application for permission
to remove the child from Milwaukee, Wisconsin, to St. Paul, Minnesota. Her petition stated she had encountered such interference
in raising the child from the paternal grandparents that the child was unmanageable and the paternal grandparents had continually
attempted to alienate the affections of the child. It was also stated the father had been absent from the state for some six
months. At the hearing the appellant appeared, having returned from California. The trial court granted the respondent's motion and
an order to that effect was entered, which also provided the appellant would be allowed to have the child for three weeks
each year at his domicile and to visit the child in Minnesota twice a month for periods of 48 hours. The defendant husband
appeals.
